FDA Issues Final Guidance on Nutrition Facts Label & Serving Size Rules

With the New Year 2020 manufacturers with $10 million or more in annual food sales must comply with FDAs updated Nutrition Facts rules initially announced in May 2016. Since then the rules have been updated and Guidances for Industry have been released by FDA.

Serving Size & Dual-Column-Labeling

 

Among the changes are the Reference Amounts Customarily Consumed (RACCs) and related matters such as serving sized and dual-column-labeling. The reasons for those changes, according to FDA, are changes in eating habits in the United States.

To help the industry better understand the requirements on December 31, 2019, FDA released the Guidance for Industry ‘‘Serving Sizes of Foods That Can Reasonably Be Consumed At One Eating Occasion, Reference Amounts Customarily Consumed, Serving Size-Related Issues, Dual-Column Labeling, and Miscellaneous Topics,’’ which replaces a draft guidance released in 2018.

As one of the main topics of the guidance FDAs understanding of a single serving container is explained.

Additionally, it is outlined what RACCs are and how to determine serving size based on RACCs. With that many examples are given specifically for products that are not clearly mentioned in the regulation.

 

A major update for the nutrition facts is the dual-column labeling for products that are packaged and sold individually and that contain at least 200 percent and up to and including 300 percent of the applicable RACC. The guidance lines out how the dual-column nutrition facts table must look, when it must be applied, and what exemptions exist.   

 

Certain products are not affected until further notice

 

The guidance reiterates that FDA will exercise enforcement discretion with respect to certain bottled water products, coffee beans, tea leaves, plain unsweetened coffee and tea, condiment-type dehydrated vegetables, flavor extracts, and food colors that do not meet the new requirements until a future rule specific to labeling requirements for those products is enacted.
